Offer
This agreement is concluded between LLC "PROFDRIVE UKRAINE", hereinafter referred to as the "Seller", and the user of the services of the website, hereinafter referred to as the "Customer". It regulates the terms of ordering, purchasing, and delivering Goods through the website https://chastotnik.ua. The Customer, acting with the intention of purchasing the Goods, agrees to the terms of this agreement under the following conditions.
1. DEFINITIONS
1.1. A public offer (hereinafter referred to as the "Offer") is a proposal from the Seller to an indefinite circle of individuals to conclude a sales agreement for the goods remotely on the terms defined in this Offer, including all Appendices.
1.2. An Order is the decision of the Customer to order the goods and arrange for their delivery, formalized in the online store.
2. GENERAL PROVISIONS
2.1. The information provided below constitutes an official offer (offer) from the online store https://chastotnik.ua to any individual (hereinafter referred to as the "Buyer") to conclude a sales agreement for the goods.
2.2. According to article 642 of the Civil Code of Ukraine, the full and unconditional acceptance of the terms of this offer (offer) is considered to be the fact of placing and confirming the order.
2.3. By placing the Order, the Buyer confirms the agreement to and unconditional acceptance of the terms of this offer.
2.4. By entering into the Agreement, the Buyer confirms that:
- a) they are familiar with and agree to the terms of this offer;
- b) they give consent for the collection, processing, and transfer of personal data, which remains valid throughout the term of the Agreement;
The Customer also confirms that their personal data is being transferred to the Seller for the execution of the Agreement, as well as for the possibility of receiving documents.
3. PRICE OF THE GOODS
3.1. The price for each Product is indicated on the website of the online store.
3.2. The Seller may unilaterally change the price of the goods.
3.3. In the event of a price change for the ordered Goods, the Seller is obliged to notify the Buyer of the changes.
3.4. The Buyer has the right to confirm or cancel the Order if the price has changed.
3.5. A change in the price of the paid Goods is not permitted.
3.6. The payment terms for the Goods are specified on the website of the online store in the section DELIVERY AND PAYMENT.
4. ORDER PLACEMENT
4.1. Orders are made through the Operator by phone: +380931701425 or through the website service.
4.2. At registration, the Buyer agrees to provide:
- 4.2.1. surname, first name, patronymic;
- 4.2.2. delivery address;
- 4.2.3. email address;
- 4.2.4. contact phone number.
5. DELIVERY AND HANDOVER OF THE GOODS
5.1. The methods and terms of delivery are specified on the website in the section DELIVERY AND PAYMENT.
5.2. Self-pickup is possible at the address: Kyiv, L. Rudenko St. 6A, office 619, from 09:00 to 18:00 (Mon-Fri).
5.3. Delivery can be carried out by either the Seller's own means or through a carrier.
5.4. The Customer must check the compliance of the Goods with the specifications in the presence of the courier.
6. RETURN OF GOODS
6.1. The Customer has the right to refuse the goods before their handover. Returns are possible provided that the goods retain their marketable appearance and there is a document confirming the purchase.
6.2. Returns are possible if the goods have individually defined properties, in accordance with the law.
6.3. Returns of goods take place at the address specified in the section CONTACTS.
7. RESPONSIBILITY OF THE PARTIES
7.1. The Seller is not responsible for damages caused by improper use of the Goods.
7.2. The Seller is responsible for fulfilling its obligations in case of providing false information.
7.3. The parties are released from liability in case of force majeure.
